Constitutional Foundations and Limits of a Prospective Reform of Local Self-Government

The aim of the paper is to analyze the constitutional foundations and possible constitutional limits of a prospective reform of local self-government. The author examines the boundaries within which the legislature may operate when designing a territorial reform, so as to ensure that the proposal is constitutionally compliant while simultaneously respecting the right to local self-government. Special attention is given to the practical implementation of the principle of decentralization in a democratic society in contemporary Slovakia, illustrated by the constitutional practice related to the development of the right to self-government. The paper further highlights possible approaches to formulating a constitutionally conform proposal for reform that respects the best interests of territorial communities, including through recognition of their territorial identity (a concept introduced and legally defined by the author), while ensuring the right to local self-government in relation to the effective realization of decentralization at the local level. The contribution also outlines challenges connected with the current mode of electing political representatives in self-government, which any prospective reform will necessarily have to address.
