The Concept of Pre-Contractual Liability and its Preview in the Sources of Roman Law

The concept of culpa in contrahendo or pre-contractual liability cannot be found in any of the original sources of Roman law, whether in classical or Justinianic form. Nevertheless, the sources of Roman law were one of the basic sources of inspiration for Rudolf von Jhering. Culpa in contrahendo thus points to an interesting phenomenon, where Roman law creates an argumentative basis for a legal regulation, the full application of which occurs many centuries after the collapse of the empire itself. Despite the fact that it does not yet have a long-standing tradition or firm establishment in Slovakia, the growing digitalization and autonomization of electronic tools make it a concept whose popularity may significantly increase also in our context.
