Legal Sources of the CIC 1917 and CIC 1983 in Comparison with the Sources of Pre-Conciliar Eastern Legislation and the CCEO

The twentieth century brought revolutionary changes to the legislation of the Catholic Church. The first edition of the unified Code for the Latin Church in 1917 was followed by the first historical attempt to create a unified legal collection for the individual Eastern Catholic Churches. This process was not completed, and individual legal amendments were published gradually in the form of papal motu proprio. Further internal church developments were influenced by a historic event – the Second Vatican Council. The changes that the council brought to the life of the church necessarily had to be reflected in new legal collections, both for the Latin Church (CIC 1983) and for the Eastern Catholic Churches (CCEO). How did individual legal codifications approach the use of historical sources, and how are these sources cited in editions that we can consider official, even though the notes and references they contain are not of an official nature? Which editions are involved, what are their strengths, and what shortcomings can we observe? The answer to this question provided by this comparative study also offers a possible explanation for certain divergences in the perception of the importance of studying pre-conciliar sources of canon law in the Christian West and East.
